By entering this website (hereinafter "the Service"), you certify that you have read, understand, and agree to the following terms and conditions:

  • The material you retrieve from this site is for your own personal use and will not be reused in any manner, nor will it be viewed by minors.
  • You are not accessing this site from a city, state, province, county, country, or locale in which possessing, viewing, or distributing adult material is illegal.
  • Your interest in the material is personal and not professional.
  • You understand and accept the responsibility of your own actions and hereby release the creators of this site from any and all liability.
EXPECTATION OF YOUR COMPUTER

As a member of this site, it is expected that you have basic knowledge of your computer and how to configure it to play movies. All movies on this site play fine. Members may be expected to change their firewall settings, correct the system clock time, as well as update their media player software. A Members misconfiguration of their system is not the fault of this website and is not terms for a refund. A minimum of tech support can be given, but overall, the responsibility is on the member to resolve their computer issues.

The site is mobile compatible with the most popular mobile OSs, but please be aware that mobile operating systems are often updated, and can break features. Not every mobile device will work perfectly with the site.

MEMBERSHIP CANCELLATION

You may cancel your subscription at any time by visiting Member Cancelation Form. You are responsible for managing your membership. Failure to provide accurate contact information or failure to properly request a cancellation may result in your account being charged for the entire subscription amount. Recurring memberships will automatically renew unless notice is received prior to the renewal date. Emailing us to cancel your membership for you is not a reliable way to cancel, but we will try to help you cancel or guide you through cancellation.

ACCEPTABLE USE

The subscription you purchase is for your use only and entitles you to view the content of this web site on a single computer or your portable media player. If the Service detects that your account is being used by multiple parties, your account will be immediately suspended or terminated without refund. For this reason, it is important that you select a username and password that are hard to guess and that you do not share your password with anyone else. Password sharing and theft are strictly prohibited and monitored!

You may not 'scrape' the site (horde bandwidth), and you are restricted to 3 simultaneous downloads. Going over this limit may temporarily suspend your login for up to 30 minutes. This is automated, and will clear on its own.

SERVER RELIABILITY

Servers crash, pipelines to servers go down, and even hubs between you and our servers sometimes go down.

While we take every opportunity to ensure the site stays up 100% of the time with redundancy, the site can and will on occasion be unreachable. Mostly this happens for routine maintenance, or as mentioned above, hubs, pipelines, and the server itself my crash. Often the server is up and running again in minutes, but if the company hosting the bandwidth loses its functionality, there could be a delay while they make repairs, exactly like waiting for phone or electrical service to be restored. There are no refunds for downtime, as server failure is a given in most any web traffic situation. Computer, well, they crash.

CONTENT REMOVAL

On very few occasions the site will remove content temporarily or permanently. This site is a dynamic work of art and can change at any time.

PASSWORD SHARING

This site has pretty good security. We can see all your logins, what IP and location they came from, along with what you have downloaded. If a password is being used from too many different IP ranges, the system will block your account, and you need to email us (support@chaosmen.com) to see what is up.

Your account may also be suspended for:

  • Too many login attempts in a short period of time (system thinks 20 people are using the same account)
  • Too many attempts to login in with the wrong username or password (often after three attempts it blocks you for several hours)
  • Too many logins ins from too many IPs

The last one, "Too Many IPs" happens several times a month. A member's username and password is being used in 8-12 different countries and gets blocked.

Logins from many different companies means someone got a hold of your username and posted it on a password sharing site, and thieves are using your password to try to gain access to the site.

While its possible a member shared their password with one buddy, I tend to think my members are pretty honest, after all, you bought a membership to the site, why would you post it so the world can take advantage of your hard earned money and payment to the site?

So I assume that the members MUST have a security issue. Either spyware, non-secure wireless connection, or use a shared public computer. The member will be asked to clean their computer and check all security. I will also suggest that the member make sure all their online financial services are safe as well.

Once the member can reasonably assure me that they have a spyware free computer, I will reissue one time only a new username and password.

ACCEPTANCE OF TERMS

ChaosInAustin.com, Inc. provides its service to you subject to the Terms of Service ("TOS"), which may be updated at any time without notice to you. Any changes posted are effective immediately upon posting and may be applied retroactively at the discretion of ChaosInAustin.com, Inc. In addition, when using particular services, you and ChaosInAustin.com, Inc. shall be subject to any posted guidelines or rules applicable to such services which may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into the TOS.

YOUR REGISTRATION OBLIGATIONS

In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by any form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or ChaosInAustin.com, Inc. has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, ChaosInAustin.com, Inc. has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof), and you hereby waive rights to any refund.

INDEMNITY

You agree to indemnify and hold ChaosInAustin.com, Inc., and its affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

NO RESALE OF SERVICE

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

TERMINATION

ChaosInAustin.com, Inc., in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service if it believes that you have violated or acted inconsistently with the letter or spirit of the TOS. ChaosInAustin.com, Inc. shall not be liable to you or any third-party for any termination of your access to the Service.
